An English gentleman rësiding in Calcntta bronght au ac-tion against a firm of Paris pastry cooks and confectiouers ander rather interestingcircurnstances. The pla'intifiE was about to be ïnari'ied and ordered what has been called a phenomenal wedding cake from tbe derendants. A surn of f 120 was paid down for the cake on delivery. The colossal and expensive article of confectionary was packed by the plaintiff 's order, and he took it with him to Calcutta. On opening the case containing the cake when he arrived in India, the Englishinan fotind that he had literully nothing bnt a shapeless mass of crunibs. The splendid gatfcau had been hopelessly bruised and broken duricg the voyage. An act i on was then bronght against tho Paris firm for asnm of $135, which included, besidee the price paid for the cake, the cost of packing and transport. The defendants maintained betore the Paris tribunal of coinmerce that they had no more responsibility after they had dëlivered over the cake to the person who ordered it. It was true that they recornmended a packer, bnt that expert acted under the orders of another individual, who had been selected bythe plaintiiï to supeiintend the operatiou. The tribunal decided in favor of the fendants. -
