Sent Back For Another Trial
The supreme court on Monday sent the case of Louis B. Roepke against the Michigan Central railroad company back for a new trial. Roepke was employed on a Michigan Central construction train, and while engaged in straightening a pile of logs, a heavy log was rolled down the bank against him, breaking one of his legs. He brought suit, and on April i8th, 1893, a jury in the circuit court awarded him $1,000 damages. The case was taken to the supreme court by the defendant, and that body concluded that the plaintiff should not have recovered on the declaration made by him. He will be allowed to amend the declaration and proceed with another trial of the case.
