Kentucky Can't Have Hampton
Cincinnati, Jan. 7.- Judge Buchwalter hus deiivered an elabórate opinión in the case of the extradition of the Rev. A. S. Hampton, colored, demandad by Kentucky for shooting and wounding a Mr. Danham in Green county. ïhe court said that no assurance had been given that Hampton would have a fair trial. He found both the indictment and the reqnisition defoctive in form.but on the broader ground of socuring the rights of the prisoner the court held that he was justiited in refusing to surrender Hampton. The presumption that he would die without legal procoss if sent back had iiot been rebutted by proof of any kind. The court cited statistics of nineteen lynchings in Kentucky within a oomparatively short time, and recalled the faot that one of the victima had been surrendered by this oourt. The court feit the obligation to perform a moral duty in thia caso which could not bo enforced by mnndamug or other proceedings. He was wllling to remand the prisoner upon proper indictment and reqnisition if the governor or other authoritieg had provided a forcé to protect him from violence ivnd insure an impartial trial. This had not been done and the court feit bound tb discharge the prisoner. tío much interest was taken in the case that other judges left their benchesto listen to the delivery of the court's decisión.
