At the meeting of the'cominon oouncil Monday night the following commuuioation was received and placed on file. and further consideration of the laborer's sewer olaiins went over another week: To the common council: VVhereas, one Henry Collins did on the 19th day of June, A.,JD. 1895, enter into certaiu contracts with the City of Ann Arbor, through itsduly authorized representatives, for the eonstrnction of two certain lateral sewers known and designated as the Hill sheet lateral sewer, sitnate in the lateral sewer district number three, and the Hurou street lateral sewer sitnate in lateral sewer district nuuiber four of tho said City of Ann Arbor, and whereas, section 113 of the sewer specifications of the City of Ann Arbor, the same being a part of the said ooutract of Henry Collins with the City of Ann Arbor provides : The contractor shall well and trnly and promptly pay as the same may become dne and prahlo, all iudelitedness which may be ome doe t' any persim, flrm or Corporation, od acconnt of auy labor performed, or material furnished in the coustruotion of any sewer for the City of Aan Arbor, and in case any claims íor failure to so well and truly pay for materials and labor as above, the Buard shall retain frorn auy aiouies due or tobeuomedue to the ooutraetor, a suiïicient sum to pay snch claim or claims, aud shall pay the same therofroru wben snch claim or claims, is or are fnlly proven to the satisf action of the Board. Aud, whereas, said oontractor, Heury Collins,has failed to pay certain claims that have become doe for labor aud material used in the constrnction of said sewers, wbilch failure has hsen brongbt to the atteution of this Board, therefore: Be it resolved, that this Board deerns it expedient to exeroise rhc authority vested in it by said section 113 of the sewer specifioations of the City of Ann Arbor, and hereby declaro that the Board does retain all money due, or to become due said coutracrtor, Henry Collins, foi the constrnotion of said sewer ; sMd money to be held for the benefit of said claims for labor and material, furnished in the constrnction of said sewers, said money to be paid on such claims as the Board may deem expedient, when the same are proven to its satisfaotion. And be it fnrther resolved that the clerk be instructed to notify the Common Council of Míe City of Ann Arbor, and said contraotor, Henry Collins, of this deolaration. T. A. Bogle was, on motion employed to asáJst the city in the suit of Herman Husz'e vs. the city. Contractor Hutzle's claim against the city accordiug to hifi figures, is $3,427.91. The oity figures it at $516.84, and ordered the olerk to make tender of that amouut. John F. Lawrence was employed to assist the city attorney in the case of Ann Walkei vs. the city, now appealed to the supremo court.
