The supreme court haa afiirmed the judgment of the Wayne oircuit conrt in the case of JVIcUurdy C. LeBeau, formerly of Ann Arbor, vs. the Telephone & Telegraph Coastruction Co. Mr. LeBeau was coming down the street as the company's ■workmeu were laying wires underground, at the ohamber of Commerce building in Detroit. They had a manhole open, and beside it they had set a barrel. LeBeau apparently paid no attention to bis surroundings, aud walked into the opening, strikiug bis chin on top of one of the barrel staves, inflicting serióos injuries. He sued for daruages, but tbe iower court directed a verdict for the eompany un the grouuds uf contributary negligence. This was afiirmed by the supieme court. whioh says that a person canuot walk about oblivious of his surroundings and theu recover daniages if irjjured.
