Milwaukee, May 21. - It has justleaked out that au order discharging F. ï. Day, ex-president of tlie Planklnton bank, from custody has been entored. The order, whieh consists of but a few lincs, was flled quietly several weeks ago by Judgu Goodland. At the time the jury found Mr. Day not guilty on the count on which District Attorney Brazee chose to try hini, Mr. Brazee objected to his being discharged, for the reason, as he stated, that he dosired to try him on the other count of the indictinent. Mr. Day's attorneya insisted that their cliënt had a right to go free, as the district attorney had selected which count he would go to trial on, and, having been cleared by the jury, Mr. Day was entitled to a discharge. In the same connection, it is said, the casea of the Plankinton bank will expire by lirnitation June 1.
