Lansing-, Mich., Feb. 2.- Attorney P. A. Baker of Detroit has filed in the supreme court an application for an -order equiring the common council of Detroit to show cause why a mandamus should not issue to compel that body to order a special election for the purpose of electing a mayor -of the city to succeed Mayor Pingree, who, it is aleged, has vacated the office of mayor by accepting the office of governor. The application is made upon the relation of DeWitt H. Moreland of Detroit, who recently petitioned the city council to cali such special election. The relator claims that to hold both offices is incompatible and contrary to the state ccnstitution and that by accepting the office of governor Pingree ipso facto vacated the office of mayor. The supreme court Tuesdaydeclined to take up the petition for a mandamus to compel the ousting of Oovernor Pingree as mayor of, Detroit excepting as an appeal from the county court.
