Mr. Wetherbee at the same time has appealed Judge Carpenter's decisión to the supreme conrt. The second case is that of Nioholas Miller, who, through his attorneys, Lehman & Stivers, files a olaim for 000 for injuries sustained on a defeutive sidewalk on Miller ave. The bill sets forth tbat Miller had the tibia and fibala of his right leg broken, and alleges the injniy kept him ooDfined to his bed for 10 weeks and that he is still uuable to perform manual labor. Unless each of these modest claims for damages is allowed by the connoil, an action at law will iu each case be commenoed.
