New York, Jan. 4. - The appellate branch of the New York supreme court has decided favorably to General W. W. Averell in his suit against the Barber Asphalt Paving company. The amount awarded him is $664,000, which with costs will aggregate nearly $700,000. This is on contracts for paving in New York, Washington, Buffalo and other large cities. The litigation began in 1883.
