COUNCIL ClIAMBER. Ana Arbor, Jan. 6th, 1898. y Adjourned session. Cailed to order by Pres. Luick. Roll cailed; quorum present. Absent - Aid. Grossman, Sweet and Soule. RESOLUTIONS. By Aid. Brown. Resolved that the City Clerk be directed to draw an order on the Sewer fuads for Forty-two Hundred Dollars and Sixty-seven Cents ($4,200.67), thirty-six hundred seventy-nine and 49-100 dollars in Sewer District jNo. 3, and five hundred twenty-one and 18-100 dollars in Sewer District No. 4, payable to Thos. D. Kearney, city attorney, to be applied m full payment for the construction oí the Huron street lateral sewer and the Hill street lateral sewer in accordance with the proposition submitted in open court for the settletnent of the case of the City of Ann Arbor vs. Tüe Farmers and Mechanica Bank, et. al. Aid. Coon moved as an amendment that the council allow $500.00 as payment in full. Lost as i'ollows: Yeas- Aid. Dell, Coon- 2. Nays - Aid. Moore, Hamilton, Koch, Brown, Vandawarker, Rhodes, Spathelf, Danforth, Cady, Pres. Luiek - 10. Whereupon the original resolution was adopted as folio ws: Yeas - Aid. Moore. To the Common Couneil: Your Cemetery Committee to whom was referred the subject of the Ceme,ery Commission of the Fifth Ward Cemetery respectf ully report that after giving the matter due consideraron hey are of the opinión that the conrol of said cemetery shonld be placed n the hands of the Common Council and recommend that the ordinanee relative to the Fifth Ward Cemetery )e so amended as to invest the nicmers of the Cemetery Committee with the powers of the Commission. llespectfully submitted, Geo. To the Honorable the Common Council of the City of Ann Arbor: Gentlemen: A decree was entered in the case of the City of Ann Arbor vs. The Farmers & Mechantes Bank et al. on Monday, January lOth, 1S98. By it the amount found to be due Mr. Collins on the Hill st. contract and the Huron st. contract including all extras on both contracts was the sum of $4,200.67. The decree provided for a pro rata distribution oí' the amount so found due as aforesaid among the different claimants. I prepared vouchers for the claimants to sign and paid them by check and filed the same with the City Clerk. L also secured receipt in full from Henry Collins and illed thsauie with the vouchers. This settlement is a final adjustment of a case that miglitbe very expensive and the cause of great trouble and annoyance to the city. Very respectfully, Thos. D. Kearney, City Attorney. This is to certify that Ed ward L. Seyler, Cit.y Treasurer of the City of Ann Arbor, had on deposit in the Farmers & Meehanics bank on the morning of the second day of January, 1898, the sum of sixty-four thousand four hundred twenty-four dollars and seventynine cents ($64,424 79). Resolved, that the Commissioners of the Fifth Ward Cemetery be required to report to this Council the lots sold and money received since the last report. Adopted. Aid. Koch moved that the subject of fire alarm system be referred to the Pire Department Committee. Aid. Brown moved as a substituto that the Council defer further action until a booth is erected by the company asking for a franchise. Adopted asfollows: Yeas- Aid. Moore, Hamilton, Dell, Sweet, .brown. Spathelf, Soule, Coon, Danforth, Cady- 10. Nays - Aid. Grossman, Koch, Vandawarker, Fres. Luick - 4. Aid. Hamilton moved to reeonsider the vote on Aid. Brown's substitute. Lost as follows: Yeas - Aid. Hamilton, Grossman, Koch, Vandawarker, Spathelf, Soule, Fres. Luick - 7. Nays- Aid. Moore, Dell, Sweet, Brown, Coou, Danforth, Cady - 7. On motion the Council adjóurued.
