The aotion was brought for the speciflc performance of a oontraot to furnisb the complaioant a pass over the road in retnrn for her olaims that the road was using a portion of her land near tbe Lake Sbore crossing for a right of way. Jndge Kinne's decree reads as follows : "I find that the material allegations in the bill of oomplaint are sustained by the evidence. "I find that the pass issued by the Ann Arbor & Ypsilanti Street Railway oompany to the oomplainant is a valid contract and that it is the dnty of the defendant to reoognize and execute the oontraot. "I thiuk the complainaut is entitled to the relief songht and a deoree may be entered nccordinglv with costs. Circuit Judge. "
