Hamilton moved to strike out the following from the report of Street Committee in the priuted proceedings of June20th, 1898, "that $400 be appropriated for turnpiking Main st. from Catherine to Depot sts." on page 40. To the Common Council: Your Committee on Finance would present the bill of the Ann Arbor Electric Co. for street lighting during the monthof June at $558.10, also the bill of extra lighting for f our nights in the month of May at $75 with the recommendation that the June bill be allowed as presented and that the bill for extra lighting be allowed at $37.50 or onehalf of the sum charged. And your Committee would further recommend that the Ann Arbor Electric Co. be directed in the future to turn on no lights when not provided for in the moonligbt schedule unless ordered by the chairman of the Lighting Committee or in his absence by the City Clerk who is hereby instrueted to consult the proper officials relative to the same and authorized to certify to all bilis for extra lighting. The Ordinance Committee presented an ordinance entitled "An Ordinance to amend an ordinance entitled 'An Ordinance Relative to Sidewalks' passed March 6th, 1893; approved March llth, 1893, as amended by an ordinance passed February 17th, 1896, approved February 18th, 1896," which wasgiven its flrst readiug by title. Aid. Hamilton moved that the ordinance be placed on its second reading. Adopted as follows: Yeas - Aid. Hamilton, Richards, Koch, Dieterle, Sweet, Exinger, Vandawarker, Spathelf, Weeks, Coon, Pres. Luick - 11. Nays - None. Whereupon the ordinance was given its second reading by sections. Aid. Hamilton moved that the ordinance be referred back to the Ordinance Committee. Adopted. 8TREETS. To the Common Council : Your Committee on Streets would recommend that $400 be appropriated for graveling N. Main st. and putting the street in shape for public travel between Catherine and Depot sts.; also that $400 be appropriated to gravel N. Your Committee on Sidewalks would recommend that the City Engineer prepare a profile of the grade of the sidewalk on the west side of Seventh Btreet between Huron and Liberty; on the east and west sides of Oswego street; on the west side of South State etreet between Williams and Jefferson. And further, your committee would recommend that stone or cement sidewalks be ordered along the following streets and in front of the following property : On the north side of East Williams in front of D. K. E. Chapter House. On the south side of East Washington from the east line of Fifth avenue east, property of D. P. White and Mrs. Henderson. Oa the east side of South Ashley street across the alley north of Liberty atreet. And that a plank siaewalk beordered on the east side of Seeond street between Jefferson and Madison. And your conamittee would further recommend that the grade of the sidewalk on the east side of Spring street between Summit street and Chubb and on the nortb side of Felch between FouDtain and Mmer be fixed and established and submit resolutions fixing such grades. Whereas, in the opinión of the Council the grade of the sidewalk on the east side of Spring street ought to be changed and tixed and established, to the end that such street may be suitable for public travel. Therefore, Resolved, and it is hereby ordered that the grade of the sidewalk on and alona: the east side of Spring street fromnorth line oí Summit street to the south line of Chubb street be, and the same is hereby chaneed, tixed and established, so that the grade of said sidwalk on and along the street aforesaid shall be as follows, that is to say: At the northeast corner of Summit and Spring street 858.80 At 107 it north of center line of Summit street and Spring street 864.50 At 250 ft uorth of center line of Summit street and Spring street 879.00 Ad 500 ft north of center line of Summit street and Spring street 896.00 At 850 ft north of center line of Summit L street and Spring street 910.00 At 1145 ft Dorth of center line of Summit Matreet and Spring street 918.50 At the southeast corner of Ci.ubb ;; street and Spring street 924,50 The elevation given being above the official city datum and along the center line of such walk, and the grade lines to consist of straight lines between the several points or stations above stated. Gentlemen : - Your Board oí Health respectfully submits its monthly report as follows: There have been held four meetings at which all members of the Board were present; thirty-two inspections have been made and nearly all of such nuisances thus inspected have been abated. The Zuern butcher shop on East Washington street has not as yet been connected with the sewer, which should be done at once. Please instruct the Board of Public Works to that effect. Your Board also requests that you instruct the Board of Public Works to have all stores and business property in the down town district connected - "' with the sewer so that we may keep this district in a better sanitary condition, whieb it is impossible to do dow. Adopted. To the Hon. Common Council: Gentlemen :- Pursuant to your reeolution passed at the special session held on the 24th day of June, 1898, I prepared a bond to be executed by the Detroit, Ypsilanti & Ann Arbor Railway and one surety, the contents of which bond, as it appeared before the erasui-es and interlineations, may be seen by an examination of the annexed paper marked "Exhibit A." The bond, as first prepared, was submitted to the company in Detroit on the 29th day of June and the officers of the company refused to furnisn any surety for the same. I then adjusted the paper to meet the deniands of tho company and I herewithsubmit it, duly executed, with the statement, however, that in my opinión the city might be unable to realize upon the paper at the maturity thereof if the company should attempt to avade it. I also herewith submit certain correspondence between the company and myself which needs no explanation. Respectfully submitted, O. E. BtTTTERFlELD, City Attorney. June 26. 1898. Mr. J. D. Hawks, Pres. Detroit, Ypsilanti & Ann Arbor Railway, Detroit, Michigan. Dear Str:- Pursuant to your pcoposition made through the Mayor and myself on the 23d inst., the city has determined to pave trom curb to curb and has directed me to secure your execution of a bond to reimburse the cost of the pavement between the rails in six and twelve months' time. They wish however that you would construct the Y at the corner of Ann street on the west side of Main rather than on east side. I have prepared a bond which I shall submit for your signature on the 29th if agreeable to you. In the meantime please rush forward your materials for the other portion of the improvement so that there may be no further cause for delay in the paving. Very respectfully yours, O. E. Dear Sir: - I have your letter of June Í5th, together with proceedings of Common Council, June 24th. This resolution of the Council is agreeable to me, provided, it isdefinitely understood .hat the "Y" on the west side of Main street, is for the purpose of turning our cars, in taking care of excursión partes to and f rom Ann Arbor. We exect to haul two trailers, so tbat the 'Y" must extend down the street far enough to turn three cara. The switches and curves of the court ïouse loop will be put in place so that ihe paving will not have to be torn up ater to put them in. I have ordered .he rails, ties and poles for the work on Hain street, and hope we may be able .0 get them in time so aa not to interere with your paving operations. Yours truly, J. D. Know All Men ty these Presents, ihat the Detroit, Ypsilanti & Ann Aror Railway, a Corporation duly organzed and existing under the laws of the state of Michigan, as principal, and the Jnion Trust Company of the city of Detroit, Michigan, as surety, are held and firmly bound unto the city of Ann Arbor, a municipal Corporation duly organized and existing under the laws of the state of Michigan in the sum of our thousand dollars lawful money of he United States, to be paid to the aid City of Ann Arbor, for which payment well and truly to be made, we bind ourselves, our successors and assigns firmly by these presents. Sealed with our seals and dated this 29th day of June, 1898. Whereas, the City of Ann Arbor aforesaid is about to construct a brick pavement upon that portion of Main treet in said city lying between the north line of Catherine street and the euth line of Williams street, and Whereas it is claimed by the said 3ity of Ann Arbor that the above bounden Detroit, Ypsilanti & Ann Arbor Railway is legally bound to pave ,hat portion of said street lying beween the rails of its tracks, and Whereas, differences have arisen between the said City of Ann Arbor and the abovs bounden Detroit, Ypsilanti & Aun Arbor Railway, because said Railway desclaims any such legal obligation, a settlement of which in due course of law would tend seriously to delay the public improvement aforesaid. Now therefore, the condition of this obligation is such that if the above aounden Detroit, Ypsilanti & Ann ArDor Railway shall replace its present equipment upon that portion of Main street above mentioned with tubular ron poles, steel ties on concrete foundation and grooved girder rails, and use .ts best eft'orts to do the same, at such ;ime and in such manner as not to deLay the work of paving said street, and shall further pay to the said City of Ann Arbor the cost of so much of said pavement on Main street as lies between the rails of the said railway, Lncluding all spaces between doublé tracks and switches, at the rate per square yard paid by the city for the construction thereof in the first instance, according to the measurement of the City Engineer, one-half thereof to be paid in six months from this date ind the balance in twelve months from this date, aad shall further pay all damages caused to the said city by any failure or delay due to the fault of said Railway in respect of the replacement of said equipment as aforesaid, then this obligation to be void, otherwise to remain in f uil force.
