PETITIONS AND COMMUNICATIONS.

A petition signed by Eugene Oesterlin asking for the 5 per cent due on Sewer District No. 5 was read and referred to the Board of Public Works.

A petition signed by Charles R. and Salome T. Gardner asking for the improvement of the Boulevard was read and referred to the Street Committee.

To the Common Council: 

The Board of Public Works would recommend that the Council take action relative to removing scales located in the street in Pavement District No. 3. --Respectfully submitted, Glen V. Mills, City Clerk.

Ald. Koch moved that the subject be referred to the Street Committee. Adopted.

To the Common Council: 

The following is an estimate for storm sewer on Detroit st. from Division to Kingsley.   580 ft. 18 Inch pipe at 34c per ft... $197.20; 580 ft. trenching at 20c per ft... $116.00; 2 catch basins at $20 each... $40.00; Total... $353.20 --Geo. F. Key, City Engineer.

The Board of Public Works present the report and estimate of the Engineer for the pavement in Pavement District No. 3 for the consideration of your honorable body. --Respectfully submitted, Glen V. Mills, City Clerk.

Gentlemen: Herewith is appended a detailed statement showing the amount of foot frontage in Pavement District No. 3 for and against as determined by the signers on the petition.

The total foot frontage is 1,488 ft., of which 1,010 ft. 8 in. is for, and 477 ft. 4 in. is against the improvement. --Geo. F. Key, City Engineer.

ORDINANCE.

Chairman Cady presented an ordinance to amend an ordinance entitled " 'An Ordinance Relative to Street Paving' passed by the Common Council the 7th day of July, 1897, and approved the 12th day of July, 1897," for its third reading.

Ald. Brown moved that the reading be postponed until next session.

Adopted as follows:

STREET.

To the Common Council:

Your Committee on Streets would recommend that $200 be allowed Christian Mack as payment in full for that portion of Third st. on his property.

And further that $353 be appropriated to extend the storm sewer on Detroit st. between Division and Kingsley.

And that $50 be appropriated to plow out the gutter on the west side of Seventh st. from the north line of Madison st. south and place the dirt in the middle of the street so as to carry the storm water. --Respectfully submitted, John Koch, Emmett Coon, C. And that the following sidewalks be ordered built:

On the north side of Catherine along the property of Barney.

On the east side of Spring along the property of Meyers.

Ann Arbor, Mich., Nov. 7, 1898.

To the Hon. Mayor and Members of the Common Council.

Gentlemen: - Your Board of Health begs leave to make their report for the month of October. There have been thirty-five inspections made and those nuisances thus inspected abated. 

The health of the city continues good, there being only nine deaths to report for the month.

Your Board of Health would request that the Council instruct the Board of Public Works to have the property occupied by Mr. H. O. Walters on E. Ann street connected with the sewer as it is in a very unsanitary condition, and there has been a number of cases of sickness in families residing in this property.

Your Board would also suggest that it would be very wise if the Council would provide us with a pest-house, as there are a number of places in the state infected with small-pox, and many of our soldiers returning from the war are likely to bring diseases into our midst, if such were the case we are not in a position at present to cope with them should they break out. This we deem is very important as former Boards have had a great deal of trouble in times gone by when such diseases broke out and there was no place to take them.

We would also ask that the Board of Public Works notify all property holders on the line of the finished sewers, that the sewer is completed and ready for them to connect. --Eli W. Moore, President; H. B. Dobsley, Inspector; E. A. Clark, M.D., Health Officer.

Ald. Brown moved that the Walter's store on E. Ann street be ordered connected with the sewer.

Ann Arbor, Mich., Nov. 7, 1898.

To the Honorable Common Council of Ann Arbor.

Gentlemen :- I desire to call your attention in reference to pavement tax levied in District No. 1, this city.

The rate per front flagging is $5.48 as against $4.79 1/2 in District No. 2, the additional cost in District No. 1 being for the paving in front of the Court House.

A number of people are desirous of paying their tax in full to save the 5 per cent interest rate, but absolutely refuse to do so, as long as the cost of the Court House flagging is assessed to them in proportion to the frontage.

Unless the matter is adjusted, it will cause a great amount of trouble in the future. --Very Respectfully, Edward L. Seyler, Treasurer.

Ald. Hamilton moved that treasurer be directed to remit 68 1/2 cents per front foot in pavement District No. 1.

State of Michigan, County of Washtenaw, ss.

 Zenus Sweet, city marshal of the City of Ann Arbor, being duly sworn, deposes and says that on the 26th day of October 1898, he gave notice of the pendency of the question of ordering the improvement proposed by the petition referred to in the resolution of the Common Council of the City of Ann Arbor of which the annexed is a copy, to the owners. occupants, or persons interested, by delivering a true copy thereof on the date aforesaid to each of the following named persons, personally: Mary Maynard, Leonhard Gruner, Lucy E. Whitlark, Ellen Morse, S. R. Gregory and wife and sister, and to St. Andrews Episcopal Society by delivering a true copy of said resolution to Harry W. Douglas its agent. --Zenus Sweet.

Sir:- Whereas the Common Council of the City of Ann Arbor has been applied to in writing by ten or more freeholders of said city to lay out, establish, and open a continuation of Catherine street, between North Division street and N. State street; and whereas at the adjourned regular session of the said Common Council held at the Council Chamber in the City of Ann Arbor, the 6th day of September, 1898, it was determined by said Council that it is advisable to lay out, open, and establish a street described as follows, to-wit: 

Commencing at a point in the east line of N. Division street at the southwest corner of the Episcopal church property; running thence easterly along the south line of said property and on said line extended to a point in the west line of N. State street, thence southerly along the west line of State street forty-five feet; thence westerly parallel to the first line to a point in the east line of N. Division street forty-five feet from the place of beginning; thence northerly on the east line of N. Division street forty five feet to the place of beginning.

To the Common Council of the City of Ann Arbor, Acting as Commissioners of Highways for said City:

The undersigned residents and freeholders of said city, owning property abutting upon the street proposed to be opened between Division and State streets in said city, as a continuation of Catherine street, of a width of forty five feet, hereby object to the opening of said street for the reason, among others, that there exists a public street or highway extending from Division street, in an easterly direction, along the north line of lands formerly belonging to Mrs. Mary J. Maynard for a distance of thirty-six rods, more or less, of a width of thirty-nine feet, and on and over the lands now proposed to be taken for a public street.

Also that the grant and conveyance by Mrs. Mary J. Maynard to the City of Ann Arbor, of the strip of land thirty-nine feet wide, and extending east about thirty-six rods, bearing date the 7th day of March, 1898, and the acceptance thereof by the city constituted such strip of land a public street and highway, and that there exists no necessity of condemning such lands for a public street. --St Andrews church, by H. Whereas, more than ten freeholders residents of the City of Ann Arbor, having petitioned this Council praying for the establishment of a certain Street within the corporate limits of the City of Ann Arbor and hereinafter particularly described; due notice of the hearing of such petition having been giving and this day having been assigned for the hearing thereof, and all persons interested therein having been heard, and it appearing to this Common Council that such proposed street and the establishment thereof is a necessary public improvement, therefore be it

Resolved, and it is hereby ordered that a public street or highway be laid out, established and opened within the limits of the City of Ann Arbor and as a continuation of E. Catherine street in said city between N. Division street and N. State street, and more particularly described as follows: That is to say, commencing at a point in the east line of N. Division street in said City of Ann Arbor at the southwest corner of the lands of the Episcopal Church Society and running thence easterly along the south boundary line of the said church property and on such line projected easterly, to the west line of N. State street; thence south forty-five feet; thence westerly and parallel with the first line to N. Division street; thence north along N. Division street forty-five feet to the place of beginning.

Ald. Hamilton moved as a substitute that the subject of opening up Catherine street be laid over until next session.
