Jüdge Kinne Monday morning denied the application of Eliott O. Qrosvenor, state dairy and food commissioner for i a mandamns to compel Jnstice Duffy ;o entertain a complaintagainst Gaspar Riusey, the weil knowii grocer, for selling oleotnargarine not of the color required by law. Onr readers will remember that this is the application spoken of in Satnrday evening's paper and is made for the purpose of testing ;he constitntionality of the law, which has never been before the snpreme court There is no question of any ntent to deceive on the part of Mr. Rineey. Mr. Grosvenor called for oleomargarine and got a poond package of it, duly labeled "oleomargarine," ;he only fanlt fonnd with it was that it was "of the color of rich June but;er. " Cavan aagh & Wedemeyer, the state's attorneys in the case will at ouce apply for a mandamns to the supreme court.
