City Attorney Claims that the Three

Storm Sewers are Treated as One

Sewer in the Bid

At the meeting of the board of pub-

lic works last night the matter of

Hutzel & Co.'s storm sewer contract

was brought up. The intent was when

the contract was let that, as in all

other contracts, a part of the payment

shall be made on the work as it pro-

gresses.

The opinion, however, of City At-

torney Norris is that as the contract

for the three storm sewers was let as

one and not -as separate sewers, Hutzel

& Co. could not receive any pay until

the whole job is completed.

It is quite likely that the matter will

be adjusted by the council at a special

meeting. Otherwise the contract can

be thrown up if Hutzel & Co. choose to

do so.
