Petition To Clean Out Two Drains Dismissed

A preliminary hearing was had this afternoon by Judge of Probate Newkirk on the petition to clean out Sugar No. 1, Black Fork, and Sugar Creek No. 2 drains in Augusta township. M. J. Cavanaugh of he law firm of Cavauaugh & Wedermeyer appeared for Daniel Barry the drain commissioner and Attorney William H. Murray for the contestants. Without going into the merits of the case, Mr. Murray objected to the hearing on the grounds that the ditches affected waters in two counties and therefore the county drain commissioner of Monroe county should have been notified of the proceedings. He presented a neatly drawn map of the ditches and grounds. Mr. Cavauaugh did not dispute the proposition of law as to drains affecting other counties. He said it was only a question of proof. Witnesses were sworn and proof given sufficient to satisfy Judge Newkirk and the petition was dismissed. Among those present from the township of Augusta were Henry Thompson, David Lindsley, Daniel Murray, and Jonathan Wardell.
