    Daniel W. Barry, county drain commissioner, by bis solicitor, Thos. D. Kearney, has filed a bill of interpleader. He alleges that Aug. 2, 1898, he made a contract with John W. Herriet and Henry Schulte for the construction of a certain drain known as the Koebbe Tile Drain, in the township of Freedom, for the sum of $300, payable on March 15, 1899, the conditions of the contract being that the work on the drain be finished according to the plans on or before  Nov. 1, 1898.

    The drain was not completed according to contract but the work was completed by one Louis Koebbe, and now Louis Koebbe and Edward Koebbe and Frank H. Koebbe claim the $300 less $2, which claim is however denied by Messrs. Herriet & Schulte.

   Messrs. Cavanaugh & Wedenieyer, attorneys for Louie Koebbe and Edward Koebbe, threaten to bring action to recover the money due for the drain. Drain Commissioner Barry says he has no personal interest in the matter, except to see that justice is done. He therefore asks permission to pay 298 into court and that the several rights of the party be adjusted.
