Railroad Damages
Ann W. Pickard, who was injured April 8, on Ashley st. , at the Ann Arbor crossing, in the city of Ann Arbor, has by her attorneys Lawrence & Butterfield commenced suit in the circuit court against the Ann Arbor railroad company claiming $10,000 damages. The suit has been commenced by declaration. After charging that the defendant is a Corporation and that the street is a public highway, and that the Ann Arbor road was in duty bound by the ordinances to maintain a safe and convenient crossing for public travel and in good and reasonable repair, she avers that this sidewalk crossed a ditch that made a railing necessary. The railroad company having neglected to keep the walk in good repair or protect the same by railings the plaintiff on the night of the day mentioned fell from the walk at the end or side, "and then and there received divers and sundry severe, temporary and permanent injuries and sustained a fracture of the bones of her leg and severe contusions, bruises, wounds and injuries to her hip, thigh and leg and severe contusions, bruises wounds and injuries to her hip, thigh and leg and was greatly bruised and injured upon other parts of her body and suffered a severe nervous shock and mental strain and severe exposure to the cold by reason thereof, and in consequence of said injuries she has suffered great pain and distress of body and mind and has been confined to her bed from thence hitherto and has been hindered and prevented from attending to her necessary affairs and business during all the time and is seriously and permanently injured and has been forced to pay out and expend large sums of money to wit the sum of $500 for physicians. medicine, nurses, attendants and other expenses to the damage of the said plaintiff of $10,000.
The declaration is very full and covers all possible contingencies in pleading, there evidently being no chances taken as to any error in pleadings.
