KINNE THOUGHT IT OVER

In the case of Mary Tubbs vs. Hannah Higgins.

In the case of Mary Tubbs vs. Hannah Higgins, the now celebrated Dexter law suit, Judge Kinne has granted a new trial upon motion of the plaintiff's attorneys, Randall & Jones.

This was the case where Mrs. Tubbs claimed an assignment from her husband of all his draying and cartage bills. She sued Mrs. Higgins for $90 worth of these bills. The jury remained out for three days. In the meantime they returned and announced that they could not agree. Both Mr. Randall and Mr. Cavanaugh insisted that the jury should be discharged. Judge Kinne talked to them very sharply and sent them back. They brought in a verdict, not for the plaintiff, but for the defendant for $25.

The plaintiff made a motion for a new trial. Yesterday was the time set for hearing the motion. Judge Kinne said he had been thinking the matter over, and ordered the clerk to grant the motion.

Attorney Jones remarked that the defendant's attorneys were not present.

"Well, I will grant a new trial, any way, and if they want to talk to me about it afterwards they can," said His Honor.
