To Enforce the Collection of the Shadford Judgement.

Amounting to $7,000

And Against Old Ann Arbor Street Railway Co.All Stockholders Brought In

A. J. Sawyer & Son are about to file a sweeping bill in the circuit court to see if they can collect the $7,000 judgment in favor of John Shadford against the Ann Arbor Street Railway Co.

Along back in 1895, John Shadford was injured while fixing a trolley wire on the road. He sued the company and got a judgment of $4, 000. The railway appealed and was given a new trial. Then the Ann Arbor Street Railway Co. merged into the Ann Arbor & Ypsilanti Street Railway Co. On the second trial the jury awarded him a judgment of $7,000. Then the Ann Arbor & Ypsilanti Street Railway Co. was absorbed by the D., Y. & A. A. Railway. The supreme court sustained the judgment of $7,000.

When the Ann Arbor Street Railway Co. sold out to the "Ann-Ypsi" a bond was given to the latter company that they would not be held to pay any judgment which Shadford might finally obtain, but the identity of the men who signed the bond is not known except to those who made the deal.

A. J. Sawyer & Son will file the bill against the stockholders of the old Ann Arbor Street Railway Co., against the stockholders of the old Ann Arbor & Ypsilanti Street Railway Co. and against the D., Y. & A. A. railway.

"We will make them all parties to the suit," said Mr. Sawyer. "Somebody must be responsible to pay that judgment and if we gather them all in, I think we can get a decree against somebody who is responsible.

The D., Y. & A. A. railway and the A. A. & Y. street railway seem to be protected by the bond that was given by the old Ann Arbor Street Railway Co. to pay the judgment if it was finally decided against them.

The stockholders of the original company were mostly Ann Arbor men.
