Lnst December the Assessor of Tnternnl Kevenue for tbe Territory of Utah, assessed Brighara Young as trustee for the Church of the Latter Pay Sainte an inoome tax of $39,.r59, to whieh he nd ded a peuhlty of $19,779 50. Young appeelcd from the assensment, asking to have it abated as erroneous, and raaking tno pointg ngainst it in grnng the Mormon view of the caso ; Grut tbat the truat fund was raied by tithing, and was a voluntary offerin, and oOUBĂ“qoentlj hot taxuble as inoome. The nsxt point wns, that it was taxable they had been relieved by the act of July 14, 1870, giving exemption to every fire peraous living in religious oomniUDities and holding properly in oonimon. The point of voluntary offering was decided against Hrigham Young ai Trustee by acting ComnMsaioniT Douglasa, becauee ofthofact tht punishmente lueh as excommunication and otherwie, are nietod out to those who refuso to pay the tithings, which deprive eaid offerings of all voluntary eharactor. Uu the second point, in wLioh tliey olaim to come within the law exempting common property, it was shown by the governraent that the property was not held iu eommon asrequired by tlie terms of the law, which eaye the property from which tbe income ariie and the income shall be held jointly and in commoD. The matter bas been pending in lbo Internal Kevenue Bureau for very nearly one year, nnd to day wa decided by Acling Commissioner Dougl8 in favor of tbo povernmont as to the tnx, lut relifiviug Young from the pi-nalty Instructions will be sent to Colleotor Hollister to oolloct the tax.
