BOSTON, July lst. Tho Supremo Court has given a decis ion in t.lü' oase of John Carew vs. Ales ander Eutherford and othors, a suit t recover back money paid tho defendants -aIhi are members of the Journeyinai l'n.-rstono Cutters' Assoeiation oí thi city and vioinity. It appcarod that th plaintUf, who is :i cutter o iSouth Boston, and not a memberof Un as.sociu.tion, had made contracta to f urn ísli out freestone fot various" buildings among othors tlio lioraan Ciitholic cathe deral. By a vote oi' th.e ton penalty oí $500 was imposed apon fin plaintiü' because he had Bent Bonie of las one to New York to be cut, con trary to tho rulos of the association. Tin plaintiff refused to pay this sum, but subscqufiitly paidit.it being otherwise impossiblo í'or hiía to perfonn his contract. He now sued to recover this sum back and damages for injury.sustained by him, by roason of the acts of the dofendants. At tho trial in tho Superior Covirt the judge ruld that the plaintiff could not maintain the action, and judgment was entered lor the defendonts. The plaintiffalleged exooptions, which have been sustained by the Supremo Court.
