By the Presi deut of tho fuited State : Whereas, It has been brought to the notice of the President of the United Htttea that ïmmy persons holding civil office by appoiutment from him, or othervise ander the Constitution and lawsof the United States, whüfl holding Federal lositions accept offioes under the atithorty of States and Territorios in whioh they üsido, or of municipal corporations under the charters and ordinauces of such corporaitons, therefore issuming tho duies of State, Territorial or municipal offico at the samo time they are charged with the duties of civil office held under Federal authority ; and, Wherecu, It is believed, with few exceptions, tho holding ol two of such ofices by tho same person is in compatible with the due and faithfui discharge of the duties of either office, that it gives rise to great inconvenieiico and often results in detriment to the public servioe, and moreover is not in harmony with the genius of the govarnment, in view of the premises therofore the President has deemed it proper thus and hereby to gire public notice that from and ifter the 4th iay of March, A. D., except as hereiu specified, persons holding any Federal civil offico by appointment under the Constitution and laws of tho United States, will be expected, while holding such office, to abstain from holding office under any State or Territorial government, or under the charter or ordinances oí' any municipal Corporation, and further, that the aocoptance or eontinued holding of any such Territorial or municipal oiïice, whether olective or by appointinont, by any person holding civil office aa itforesaid under the Governmönt of tho United Statea, other than judicial offices under the Constitution of the United States, will be deemed a vacation of the Federal office held by such person, and will be taken to bo and will be treated as a resignation by such Federal officer of his eoniraission or appointment in the pervicc of the United States. The offices of justice of the peace, of notarios public, and commissionei's to take acknowledgments of deeds or administer oaths, shall not be deeined within the provisión of this order, and are excepted from its operation, and may be held by Federal ofricers. The appo'intment of deputy marshal of the United States may be conferred upon sheriffs and deputy sheriffs, and deputy postmasters who6e ments ot' ornee do not exeeed $bUU per annum are also excepted from the operation of tliis order, and roay accept and hold appointments under State, ial or municipal authority, proyided the same be found not to iiiterfere with the discharge of their duties as postmaster. Headsot departments and otber oöiufrs of the govemimcnt who hao the appointlai.'iit of subordínate ofíicers are required to tae notice of this order and to see to the enf'oreeinent of its provisions und terms withia the sphere of their respective departments as offices, and as relates to the several persons holding appointuieuts under thom.
