Albany, N. Y., Juno 10. - The Court of Appeals, by a unaniiuous opiiiion grants a new trial to Stokes. Aluan'Y, June 10. - The Court of Appeals wer unanimous in their opinión granting Stokes a new trial. There are two opinions written, one by Grove, the othor by Itaphael. The charge is held to be erroneous on the point that the law presumes rnurder from thefact of killing, and calis upon the prisoner to mitígate or justify ; also. that thero wore errors in exclnding the proof of threat by the deceased to kill tho prisoner; also, an error in permhting Mrs. Morse to contradict Jennie Tarner in the collateral matter called out in the cross-examination of Jennieft namely, as to whether she left Mrs. Morse's against her wish and becauso the doctors were said to be after her soon after the homioide. There wero othor points discussed, but these are the principal onos.
