ONf.ytA, Neb., July 2!). -The Union Pacfiic Railroad Ooftipany lias applied to United States Judgo Durdy for an injunctioii to reetrain the oollection of taxes levied by tlio State authority upon landa granted in aid of the oonstruction of its rond. A tempjrary injunation lms been allowed. The application ia based upon the decisiĆ³n of the United Htates Supreme Court in the Kansas Pacific Railroad Company vt, Prescott, bolding such lands not taxable tor the reasons, first, that the company has not perfeeted its right to the patenta by the performance of all the conditiona of the grant, such patenta being withheld by the Interior Department until certain expenditures recommendeH by a comuiitee of citizens appointEd in 1360 to examine the road are made ; second, the power of State taxation wouM defeat the right of the United States to require suoh lands to be sold at a dollttr and a quarter per icve after three years frotn the comple tien of the road, as provided by section 30 of tbn compaiiy's charter that il, has until July lst, 1876, to complete the road .
