Washington, Aug. 23.- The War I artraent promulgates in general oièeaml hu fíndinga and sentence in tho caHSr he Modoc captiYes, Captain Jack, SoKfechin, Black Jim, Boston Charley, BariSy, alias One-Eyed Jim, and Sleepy Joe, alias 3ox, who were tried by military comrnigsion for the murder of Gen. Canby and üommiasioner Thomas, and for assault with intent to kill the other peace commissioners. They are found guilty of the speciftcations and oharges and sentenced o be hanged. The prooeedings have been approved by the President and Seerotary of War. In the text of the general order speoiication first, uuder the charge of murder n yiolation of the laws of war, reoites that they, the Indians ooinmonly known as Capt. Jack, Schonchin, Boston Charley, Blaok Jim, Barney, alias One-Eyed Jim, and Sleepy Joe, alias Cox, members of a oertain band of Indians known as the Modocs, whioh band, including the prisoners above namod, was at the time hereinafter alleged engaged in open and flagrant conflict with the United States under the ohief command of said Captain Jack, did, as representod of said Modoc band, meet under a flag of truce and suspension of hostilities Brigadier-General E. E.S. Canby, of the United Statqs Army, comnianding the Dopartnient of Colunibia, and certain peace commissioners on the part of said United States, for the agreed and professed purpose of disoussing and arranging terina upon whioh the hostilities existing between the United State and said band should cease, and did thereupon, in wanton violation of said ilag of truoe, and treaoherously disregarding the obligations imposed by said truce under the laws of war, willfully, foloniously and of malice aforethought, kill and murder said General Canby, all this at or near the laya beds, so-called, sátuated near Tule Lako, in the State of California, on or about the llth day of April, 1-873. The seoond speoification is the same as the first, only the name of Peace Commissioner Eleazer Thomas is substituted for that of General Canby. The specifioation under the second oharge of assault with intent to kill in violation of the laws of war reoites the attempt to kill Peace Commissioners A. B. Meacham and L. S. Dyer at the time their associates, Thomas and Gen. Canby were murdered, all of whom were representing the United States. To the charges and specifioations the aoouaed pleaded not guilty, but the comniission found them guilty and sentenced them to be hanged at such time and plaoe as the proper authoritios should direot. The following is the order made by the President in the matter : Exeoutive Office, Aug. 23, 1873. The foregoing sentences in the case of Capt. Jaok, Schonohin, Blaok Jim, Boston Charley, Barney, alias One-Eyed Jim, and Sleepy Joe, alias Cox, Modoo Indian prisoners, ure hereby approved, and it is ordered that the sentenoes in said cases be carried into execution by the proper military authorities undei the orders of the Secretary of War on the third day of October, 1873. The Seoretary of War has ordered that the sentences be duly executed under direotion of the general conimanding the Department of the Columbia, at Fort Klamath, Oregon, on Friday, October 3, 1SS3.
