Mortgage Sale. DEFAULT having been made in the conditions oí' a mortgage, executed by Öeorge W. Brown and Mary E. Brown, his wife, to Sheldon Tomlinson, dated the twentieth day of April. A. D. 1871, and reeorded in the Office of the Register of Deeds for Washtenaw Couuty, Michigan, on the secoud day of May, A. D. 1871, in liber 44 of mortgageB, on page 52, by which default the power of sale therein contained became operative, and no proceeding at law or in equity having been instituted to recover the debt seeured by said mortgage , or any part thereof, and the sum of twentythree hundred and eighteen dollars and ninetynine cents being now claimed to be due on said mortgage, and forty dollars asan attorney fee as pruvided in said mortgagej Notice is therefore hereby given that said inorttrag-e will be foreclosed by a sale of the premlses therein described, or aome part theieof, viz : All of the following land, commencing twen t, y roda west of the southeaet oorner of aection twenty-nine, thence west on south line of said aection iourteen rods, thence north parallel witb CHHt line of naid section, to the south bank of the River Raisin, thence along said south bank in a northeasterly direction to a point twenty rods west of the east line of said seetion, thence south parallel with the eaat line of said aection to the place of beffinning, containing one acre and one third of land, more or less : Also, the following described piece ot land , on which a flouring mili now stands, namely: conimencing at a point twenty-five and one half rods north of the south line of said section twenty-nine, and twenty .rods west of the east line of said section, thence north parallel with east line oí said aection eleven rods ; thence east parallel with the south line of said section nine roda; thence south parallel with the east line oí said section eleven rods, thence west parallel with south line of said sectie n nine rodi to the plaoe of beginning, containing nine ty-nine rods of land. And further with the last described parcel of landisgranted, bargained, -jold and remised the right te build a dam on the river Raisin, and to flow back or up said river to tli' west line of said section twenty-nine , and the tirst j ight to draw sufficient water to drive two runs of millstones and all the necessary machinery for rinding and flouring purpoaes. The above grant bargain, lale and remise of water power is expresily made subject to oertain restrictione and rights made in a deed giren by John W. Rice and Mary B. Kice, hit wife, to Michael Kappler, dated the flfteeuth day of November in the year one thousand eight hundred and sixty-four. and reoorded in the Register' Ottice for Waahtenaw Couoty, in liberS7 ot deeds, on page 161, all ot said land being in townstip number three south of range three east, in Michigan, ut publio vendtie, at the south door of the Court House, in the City of Ann Ar bor (that being the place of holding the Circuft Court for said county), on the twenty ninth day of July, A. Colé, praying that a certain instrument now on file in thiH Court, purporting to be the last will and testament of suid deceased, may be admitted to probate, and that she may be appointed executrix thereof. Cutcheon, of said place, dated February the eleventh, 1869, and recorded in the Office of Begister of Deeds of Washtenaw County, Michigan, in líber 40 of mortgages, page 499, on sanie day it was executed, which mortgage was assigned by said Cutcheon to Mary E.
