Mr. Dancer moved that the Prosecuting Attorney be allowed one htmdred dollars for incidental expenses. Mr. Smith moved to amend by allowing the same as was allowed the last Frosecuting Attorney. Mr. Purtell presented the following as a substitute for the whole matter, which was adopted: Resolved, That the Prosecuting Attorney be allowod one hundred dollars for Incidental expenses, aud that he be instructed to render a tabulated statement of lhe numberof comraltmentsand the amount of fines due the County of Washtenaw, to this Board, at lts annual session In each year. Mr. Smith moved that the compensation of the Clerk for keeping the accounts with the Treasurer be referred to the Committee on Salaries of County Officers. Carried. Mr. Depew oflered the following as a ubstitute, which was adopted: Resolved, That all bilis reported by the Committee on Civil Claims yesterday and today be referred back to the committee, and hey be requested to report the bilis flled according to law. The following communication from the iudge of Probate was received, read, ordered flled, and made the special order for his afternoon at two : To the Honorable Board of Supervisors, Washtenaw County : Gentlemen,- In 1873 the Legislature authorzed the boards of supervisors of the various counties, except the County of Wayne, to deermine the salarles of the various Judges of 'róbate in the State. $1,500.00 was the sum üxed upou by the Board in this county. In the case of the Probate Judge of Manistee vs. the Supervisors of that county, decided by ,he Supreme Court at the April term in 1879, ;he court decided that the salary, once determlned by the board, their power is exhausted, and they caunot act again until authorized by he Legislature. Under this decisión and the aw I ain entitled to the same salary as my predecessors Judges Beakes and Cheever, to wit, $1,500 per annum. I have certainly done as much work as my predecessor, and if the aw gives me the same salary, my modesty, though great, does not prevent me from denauding it. I present this written communication to reserve my legal rights, and respectfully ask he Board to appoint a committee to investígate tlie matter. I might procure a mandamus, as did the Judge of Probate of Manistee County, but I wish to save all unnecessary cost; and I am sure that this Board, if I am legally entitled to the same salary as my predecessor, will pay it ; and if 1 am not legally entitled to it, I shall not expect it. Mr. Krapf, from the Committce on Pubic Buildings, made the foUowing report : To the Honorable Board of Supervisors of Wasliteuaw County : The undersigned Committee on Public Buildngs, who were requested to examine aud re port what was needed in the office of the Regis,er of deeds, after due examination, we flnd hat the iudexes of morteages from ÏHÖ'J to 1881 are in a very dllanidated condition and need replacing,- the office needs two more writing desks ; upou inqutry we flnd that the index book, copyiug and two writing desks suitable for the omce will cost about live hundred and ifty dollars, and we recommend that that atnount be appropriated for that purpose. We are also informed that we need some cheap book-cases for the preservatton of the old files n the county clerk's office, and as that office s short of room.we recommend that the room u tlie basement east of the janitor's room be used for that purpose. On motion of Mr. Dansingburg, the Clerk was instrueted to advertise tor proposals for furnishing medicines and medical and surgical attendance to the prisoners at the jail for the ensuing year. The chairman announced that in consecjuenee of lus cnfeebled state of health he would be wholl}' unable to perfor the duties of his position, and tendered his resignation as chairman of this Board, to take effect as soon as hisuccessor should be elected. While waiting his arrival at our lirst meeting, in March.a messenger carne announcing his sudden death. We were shocked and saddened above measure by the report. Mr. Feldkamp was an emi nently practical man, and with inoreasing experience was becomlng a valuable and useful member of our Board. We entered upon our minutes the best testimonial we could frame, expressive of our ap preclatlon of his worth, and our sense of loss at his sudden and untimely death. By his death our labor has been materially increased, - we have feit our increased responsibility, but have tried to meetitfully. We take pleasure,perhaps we may say pride, in saying that we have been able to make the expenses of the house more thau f 5.000.00 less the past year than for several years previous- that we have no debts, but a handsome balance to our credit in the County Treasury. Mr. Rohison, chairman of the Committee of the Whole, presented the following: Tlie Commlttee of the Whole, to whom was referred the inapeetion of the County Poor ' House and the County Farm, have directed me to make the followiug report: On Friday, October 14, the Board of Supervisors as a Commitleeof the Whole.made their usual aunual visit to the County House and Farm. Tosay we found the house clean and in guod order, would be but to repeat the sayings of former committees on similar occasions. In the opinión of the Committee there U now no room lor improvement in the Internal arrangement of the house, as far as clothing, bedding, cleanliness and the general appearauce of the inmates are concerned . The barna and other outbuildings are in good order; the larming tools are nicely cleaued and lioused ; the fields all show careful cultlvatlon, and a general air of good larmiug was present every wiu'i-e on the premtses, savlng, perhaps, the presenil of piles of stone in the feuce cornors and in the lields. The Committee recommend that the Keeper be eneouraged by the BuperintendeutB in bis effortR to rid the land of stone, not only thost: now in heaps, but those just below tlie surface and not out of the way of the plow ; and should the qnantity warrant jt, that the Jarger stone be put In a fence or wall until the naeds ot the farm shall require them elsewhere. The Judge of' Probate presentad tlie following communicatlon, whicli, on motion of Mr. Kliodes, was received, ordered spread upon the Journal, and refeiied to the Coniiniltei: on Salaries of County üfficers : To the Chairmau and Members of the Board of Supervisors ui Washtenaw Couuty : Oentleinen,- I desire to eall the attention of tho Board to tlie raaiter of the salary of the Judge ot Probate. For twenty years the Judge of Probate of Ihiscounly has received a salary of $1,600 per amium. iroin January, 11, to the lirst day of January last; and by an act of the Legislature last winter, the salary of tlie Judge of Probate of this county has been fixed at $1,500 per annum froni and alter the flrst day of January next. Theie only reruains tor this Board to provide for the salary for the present year, 1881. On the 26th day of October last, the Board adopted a report declaring the salary Í1. 200 for this year. but subsequent to this action the Board, on the 7th day of January last, adopted anoiher report declaring that the salary had been lixed at l,50O, and thattl,5U0 was the legal salary, thus indirectly setting aside their previous report declaring it $1,200. In view of these conflictlug actions of tile last Honra, i nave not uesirea to embarrass or íq any way eompromise the Clerk by askiug hlm to draw a warrant for any portion of my salary for this year; neither did I wish to embarrass my own oluiíu by accepting auy portion of iny salary for this-year untll i liad presented the matter to tliis Board. Since the action oí this Board in January last declaring tlie legal salary to be $1 .500. the Supremo Court has decided the case of the Probate Judge agaiust the Supervisors of St Clair Uounty, in whlch they sustaln the principie laid dowu by the court in the case 01 the Probate Judge oí Manistee against the Supervisors of that couuty; that is, the principie that the salary, once fixed, must remaiu fixed so far as theöupervlsois are concerned, unless the Judge hlmself, by taking a less salary than the one originally pald, consents to a reduction. I present this paper in writing for the very purpose ot havlug it appear upon record that I consent to no reuuction in my salary for this year. In view of the law and the declslons of the Bupreme Court, Ihts Board of Supervisors can have no responslbility as to the amount of this salary. lf it is too high, the unscrupulous Judge who takes it, and the uuscrupulous Board of Supervisors of 1S7-S who flxed the amount, are solely responsible. This Board canuot be blamed for performing the platu duty of providing for the payment of au obllgation whicli a former board legally incurred. If this was au original proposition, and the amount of the salary was to be flxed for the lirst time, there might posslbly be a show of excuse for the Board to strugglu to see how cheap it could get the service performed but it is uot an original proposition. The salary has been lawfuily tlxed and paid for tweuty years at 81,500 per year, and by au act of the Legislature it has been flxed for more than twenty years to come at 41.5U) per year after the nrstday of January next. 1 have no reason to doubt but that this Board wiil lake the manly, honorable und legal course, and provide for the payment of the saine salary this year which has been so long paid in the past, and which Is to be paid so many years in the future unless the Legislature thin'k proper to change the amount. We a'so find paid into the Ypsilanti city treasury by Justlce Forsyth since 1879, f 108.00, and by Juetica Griffln eince Jan. lst, 1881, $82.06, maklng a total of fine money in said city's treasury of $188.06, which can be had on application of the County Treasurer. We aleo find in the hands of E. W. Wallace, sheriff fine money to the amount of $5.00 paid to nim by John Cari. We also find that the county haa paid Sheriff Wallace $15.26 for board of prisoner McCoy scntenced to the county jail by Justtce Forsyth for violation of city ordinance. In the opinión of this Committee the county ehonld not pay for a violation of a city or village ordinance, and we recommend that the amount of $15.26 be deducted trom the amount due the shi'rifffrom the county. Your Committee recommend that the sheriff be required to keep the books at the jail so that he can show the names of prisoners committed for violating a city or village ordinance, and in no case where a person is committed for violating a city or village ordinance shall he charge the county for board or jail fees.
