[Pasoed May 1, 1888.] Be it ordained by the Mayor, Betwder and Aldermen of the City of Ann Arbor. Section 1. Every public carriage, cab, coach, hack or other vehicle diawn by one or more horses, or other anímala which shall be kept, used, driven or employed to convey any person, or persons from place to place, withiu the limits of the city of Ann Arbor, or to carry any person or persons by the bour in said city, for hire, shall be deemed a "hackney carriage" within the meaning of ihis ordinyice. Section 2. No person sball hire or keep for hire, within the limits of the city of Ann Arbor, any hackney carriage or omnibus without a license tberefor from the recorder. Sïction 3. The recorder is hereuy authorized to issue licenses, for the purpose aforesaid, to any resident of the city of Ann Arbor, of the age of twenty-one years, or upwards, of good moral character, upon his paying into the city treasury the sum of one dollar and the recorder's fee, and to any person, a non-resident of the city of Ann Arbor, of twenty one years or upwards, of good moral character, upouhis paying into the city treasury the sum of nine dollars aod fifty cents, and the recorder's fee, for each hackney carriage or omnibus kept as aforesaid", and executing a bond to the Mayor, Recorder and Aldermen of the City of Ann Arbor, in the penal sum of one hundred dollars, with one or more sureties, to be approred by the common council of said city, conditioned for a faithful observance of the charter and ordinances of ,said city, and that he will pay all fines, penalties, costs and damages for which he may become liable on account of such hackney carriage or omnibus, undur his license as aforesaid, and such liceuse shall st Ue the number of each hackney carriage or omnibus, with the name of the person to whom granted. Section 4. No person shall drive or be permitted to drive aay hackney carriage or omnibus, without being licensed as a public driver by the recorder. Section 5. The recorder is hereby authorized to grant licenses to residents of the city of Ann Arbor, of the age of twenty-one years and upwards of good moral character, to act as drivers of hackney carriages or omuibuses, on the person appjying for buco license paying into the city treasury the sum of seventy flve cents, and if a non resident the siim of one dollar and seventy five cents, together with the recorder's fee, and executinc a bond to the Mayor, Recorder and men of the City of Ann Arbor, in the penal sum of flfty dollars, with one or more sufficient sureties, to be approved by the common council, conditioned as prescribed in section three of this ordinance. 8BCTI0H 0. Eyery conveyance lisensed under this ordinauce, when driven or used at night, shall be provided with two lighted lamps, with plain glass fronts and sides; and shall also have the number thereof as stated in the license paintcd in legible characters thercon, or upon sume durable substance to be placed in conspicuous places on the outside of each hackney carnage or omnibus in such a manner that the same may be distinctly seen and read when the conveyance is standing or in motion. öection 7. ivery person licensed under this ordinance to keep a hackney carriaze or omnibus, shall at all times keep a good aud sufficient carriage and horses. Section 8. No owner or driver of any hackney carriage or omnibus while waitiug for employnient, shall refuse or neg lect when applied to, to convey auy person or persons to any place or places within the City of Aun Arbor, and on the I person or persons being placed in such couveyance. the same shall be driven by the most direct and safe route, to the place to which such person or persons may wish to go, and not elsewhere; and uo dnvur or owner of any conveyance except omnibuses, shall, without the consent of the persou or persons therein, or of the Derson vrho first engaged such conveyance, place thereiu auy other person or persons. bECTiON 9. No owner or driver of any hackney carriage or omnibus shall suffer I the same to remaní on any street, square lañe or ailey, without aome proper person to take care of the same, and no owner or dnver of aoy backney carriage or omnibus while waiting f or employment at the depot or on any street, shall snap or flourhis whip, or be gu-lty of any rude or boisterous conduct or language SKCTION 10. Every driver of any backney carriage or oiiiLibus while thcsame is waiting for euiployineut, snall reniain ou. or near tne same, and shall so keep his conveyance and horses. asthat the same shall not obstruct the travel ou any slreet avenue or cross-walk. Section 11. No person unlcss licensed as an owner or driver, au herein provided shall procure passengere for, or charge or j receive any fare for any hackney carriage or omnibus, and not more than oue licensod persou bhall take charge of or drive ou or in any such conveyance. Section 12. The drivers or owners of hackney carriages or omnibuses, may deïnandaud receive for conveying passengers the tollowing rates or prices of fare and no more, to-wn: Twentyfl ve cents to or f rom the depot to any place within the city limits for each passenger and where the time occupied does not exceed half an hour, twenty flve cent rwr nde for each passenger; aDd where the time occupied is more than half and less than an hour, flfty cents per ride for ach passenger; children bet ween the aces of tour and twelve years when accompanied l Jr. P,a!nts or uardian shall bc charged half fare, and chiJdren under four years of age shall be carried f ree of charge. Fo! the use of any hackney carriïge or omnibus by the hour for not more than four persons, and with the privilege of I gmng from place to place and stopping as ofteu as required, one dollar per hour for the firsv hour, and seventy-flve cents for each additional hour, and for fractional hours at !he rate of seventy-flve cents per hour; and for each additional passender twenty-five cents. When ahackney carriage or omnibus is used between the bours ot eleven o'clock p m and flve o'clock a. m. it shall be lawlui to demand and receive for tbe same ser vices doublé the rates prescribed above Any disagreenient as to time and rates shall be determined by the mayor, whose decisión shall be 3 nal. 8ection13. There shall be flxed in every hackney carriage or omnibus licensed under this ordinauce, and in such manner as to be conveniently read by any person in the same, a card containing the name of the owner of such conveyance, the number of the conveyance, and the whole of section twelre of this ordinanrp printed in plain legible characters. The said card shall be furnished bj the City of Ann Arborand begiven to any licensed owner or driver who may apply for the same. Aoy driver who shall drive ahackney carriage or omnibus without such a card being placed therein, aud any owner who sball negleci to place such a card in his conveyance, shall be punished as hereinafter provided. Section 14. This ordinance shall apply to any carriage or omnibus which may at any time be placed upon a public stand, for public hire, and to all omnibuses or carriages, kept by hotel or livery stable keepers for the purpose of carrying passengers for hire, to or from the railroad depot, or other places in said city, or for carryiug any person or persons by the hour in said city. Section 15. Any violation of, or failure to comply with the provisioas of :his ordinance, shall be punished by a 9ne uot to exceed seventy-h' ve dollars aDd costs to be recovered before any justice of the peace in the City of Ann Arbor, and in the imposition of any such fine and costs, thesaid justice of the peace may make a further sentence, that in default of the paytnent thereof, within the time to be fixed in such sentence the oflender be committed to the Detroit house of correction or the county jail for any period of time not exceeding ninety days. BECTioN 16. So much of an ordinance eDtitled "an ordinance relative to hack?' cabs, drays, and otber velúcles" as relates to the subject matter contained in this or dinance.or parts of ordinances inconsistent with the provisions of this are hereby repealed. Section 17. This ordinance shall be puhlished for two weeks successively in The Ann Arbok Democrat, a newspaper published in the City of Ann Arbor and shall take effect at the expiration of fifteen days after the first insertion in said paper.
