The supreme court has reversed the decisión of the circuit court in the case of Virgli Comiskie vs. The City of Ypsilanti and it vvill have to.be tried over again. At the corner qf limmet and Ballard streets there is an open gutter and no street crossing. The plaintiff stepped off here one evening and received injuries. She commenced a suit against the city for 5,000 damagres. Lehman and Stlvers represented the plaintiff. and ex-City Attorney (Jriflin and Judge Babbitt looked after the city's case. After the testimony was all In Judge Kinne directed the jury to find a verdict for the city on the ground that the plaintiff had not shown the city to be Hable, and that the city could plan to have open gutters if it si pleased it.
