The chancery suit of Mrs. Cross and Estella Cross-Fisk vs. S. H. Dodge & Son was deeided Thur3day by Judg-e KInne. The suit grew out of the following facts: Jesse Cross, a young boy, was employed by the deferulants in their jewelry store. Articles of jewelry were missed and defendants swore that young Cross admitted to the taking of a $130 diamond ring, $32 in monty, a $9 pair of cuff buttons and other things. They also testifled that they had reason to suppose that at least $200 wcrth was appropriated and that the boy's niother and sister offered to give them a chattel mortgage on household goods and a pano for the above aniount to settle the case. Complainants swore that the chattel mortgage was obtained througfh threats of prosecution of the boy. Complainants flled a bilí to have this set aaide on the grounds of duress. Judge Kinne dismissed the bül without costs to either party but held that the mortgage was a valid Uan to the extent of $130, the same to be paid within 30 days or defendants could freclose. The complah ants threaten to appeal to the supreme court.
