BOUND OVER TO CIRCUIT COURT

Nic Schneider Was Arrested for Keeping Saloon Open

ON SUNDAY, JANUARY 5th

He Waived Examination in Justice Gibson's Court Yesterday Afternoon.

The city officials decided to make a complaint against Nic Schneider for keeping his place of business open on Sunday, Jan. 5, at which time Christian Hoerz met his death by falling down the cellar steps.

Those who were in the place at the time were brought before Justice Gibson on Saturday and their affidavits were taken.

No testimony in contradiction to that given at the coroner's inquest was developed.

This testimony showed that the friends whom Schneider had invited on Saturday night to be present at a Sunday night supper were seated in a room separated from the bar by another room and adjoining the kitchen and that nothing was served them but cider, which they swore was sweet. But Mr. Schneider, himself, swore that in this room there are two tables and some chairs and that it was his custom to serve drinks there for families who came for that purpose.

It is on the strength of this that the warrant was issued and City Attorney Sawyer will contend that this room is a part of the saloon.

Mr. Scheider was arraigned Monday afternoon and waived examination. He was then bound over to the circuit court.
