JUDGE KINNE REMINDS THEM OF NEW RULES

In the Nesbitt Case He Reduced the Verdict From $420 to $310

In the case of the Detroit Brass & Iron Novelty company vs. James Nesbitt, the jury awarded a verdict of $420 against the Whitmore Lake inventor.

Murray & Storm made a motion for a new trial. Judge Kinne handles it as follows:

"Some things were said and done during the trial of this cause by the counsel for the plaintiff which I deemed improper. I cautioned the said counsel and reprimanded them to such an extent that I thought if any harm resulted therefrom it would fall upon the plaintiff.

"In my opinion nothing said by counsel for the plaintiff to which exception was taken caused any injury to the defendant.

"But I think the verdict was excessive.

"The plaintiff must revert all over $310 and in default of so doing within 30 days from this date, a new trial may be granted."
