QUAIL AND PARTRIDGE OPEN SEASON

ATT'Y GENERAL HOLDS LAST YEAR'S LAW INVALID

The Open Season is from Oct. 20 to Nov. 30 - Letter from State Game Warden

The following letter is self-explanatory and certain Ann Arbor sportsmen should take warning:

Portland, Mich., Sept. 20,. 1902. Schumacher's Hardware, Ann Arbor, Mich. 

Gentlemen: Replying to your favor of the 18th inst., enclosing game card, will say that your season therein given for killing of partridge, quail and woodcock from Oct. 20th to Nov. 30th is correct. Section 10 of the Game Laws passed in 1901 is held invalid by the Attorney General, and under the ruling of our Supreme Court, the law of 1899 is still in force, thus making the open season on quail, partridge, woodcock and spruce-hen in the Lower Peninsula from Oct. 20th to Nov. 30th. I mail you a copy of the 1901 laws on page 81, in a note under section 10, you will find the Attorney General's opinion as stated above.

The Game Warden was communicated with by telephone this morning and stated that the opinion of the Attorney General concerning the validity of that section of the 1901 law concerning shooting quail would be enforced by the game warden's department. The reason as given by the Attorney General was that this section of the law of 1901 as signed by the Governor differed from that passed by the legislature. The bill as passed by the legislature made the open season begin October 15, but through a mistake of the engrossing clerk the bill as signed by the governor was October 1. Hence this section never became law, and the law of 1899 is still in force.
