Motion Made in Circuit Court to Declare it Void

 

On the Ground that it Discriminates Against Non-Residents and License Fee is Excessive

 

The validity of the transient traders ordinance was argued in the circuit court this morning. It came up on a motion to dismiss the case against Clark of Callahan & Co., who was arrested for a violation of the ordinance. M. J. Cavanaugh, for Mr. Clark, argued that the ordinance was void as discriminating against non-residents, and that the license fee was excessive. The city, of course, took the opposite side of the argument. This is the ordinance that Mr. Sawyer assured the council was valid and he was permitted to file a brief on the subject this afternoon. The court took the case under advisement.
