Defendants in Contempt Case Called Into Court

In the Argus of Saturday, Sept. 26, it was stated that Dean & Co. Had asked the circuit court to punish certain officials of the Ann Arbor railroad - Manager Henry W. Ashley, Roadmaster, J.O. Laughlin, Chief Engineer O.D. Richards, Foreman Joseph W. Kinsey and Engineer Wm. O. Huston - for not obeying an injunction issued by Judge Lockwood of Monroe restraining the road from building an embankment across First Street or encumbering First Street between Liberty and William streets. The order was issued by Judge Kinne for the before mentioned officials to show cause Oct. 2. Two of them, Richards and Kinsey, came into court, but the others were unable to get here. An answer was filed, however, by A.J. Sawyer & Son, attorneys for the Ann Arbor railroad in which Henry W. Ashley sets up that he is first assistant to the president of the road and was entirely responsible for whatever has been done in changing in any way the grade of the First street and that the others named are employees. He says he understood he was enjoined from building such an embankment as would entirely obstruct complainants crossing First street, but did not understand that he was enjoined from changing the grade in any way whatever, to the amount of 1.6 feet as he has done. He enters into a history of all that has ben done bearing upon the issue since the injunction was issued. He disclaims any intention of disobeying the injunction.

Judge Kinne gave defendants until October 12, to put in their personal appearance, the case being one in which they must appear in person and not by attorneys.
