ASKS RELIEF FROM FORECLOSURE SALE

E. P. Allen, as attorney for Jabez Wortley of Ypsilanti, filed a bill Tuesday a. m. commencing suit against Samuel Heavenrich to stay the operations of a mortgage foreclosure sale held October 15, 1902.

It appears from the bill that Wortley gave Heavenrich a mortgage upon certain real estate situate upon North Huron street, Ypsilanti, to secure the payment of $1,753.50. This property lies three lots, with buildings, on the west side of the street and the balance on the east side. The whole lot was sold under the mortgage and, according to law, a year given for redemption. Wortley now claims, by the bill, that he believes he is to be dispossessed of the property and asks that Heavenrich be made to show what the indebtedness is, that the sale by mortgage foreclosure be declared null and void and that Heavenrich be enjoined from taking any steps to dispossess him of his property rights.
