The case of Willis A. Hooker vs. the Michigan Central R. R. was taken from the jury Tuesday afternoon by Judge Kinne and a verdict rendered for the defendant on the ground that the injury was caused by a fellow employee and hence the railroad is not liable.
This is the case in which Hooker sued for injuries received at Leoni Junction by cars butting into a gravel train, and has occupied the court all week.
