At a sesslon of the Probate Court for the Couuty of Washtenaw. holden at the Probate Office in the City of Arm Arbor, on Tuesday, the eighth day of January, in the year one thousand eight hundredandninety-flve. Present, J. Willard Babbitt, Judge of Probate. In the matter of the estáte of Thomas Seelye, deceased. On rcading and flling the petitiou. duly verified. of Osman Cooly Seelye, praying that a certain instrument now on tile iu this court, purporting to be the last will and testament of said deceased may be admitted to probate, and that administraron of said estáte may be granted to himself, and Naomi I). Seelye and Busan Almira Kendrick, the executors iusaid wil) nained or to some other suitable person. Thereupon it is ordered, that Monday, the 4th day of February next, at ten o'clock the forenoon. be assignèd for the hearing of said petition. aud that the devisees, legateeö, aud heirs-at-law of said deceased and all other persons interested in said estáte, are required to appear at a aession of said Court, then to be holden at the Probate Office in the city of Ann Arbor. and show cause, if any there be, why the prayer of the petitioner should not be granted. And it is further ordered, that said petitioner give notice to the persons interested in said eKtate. of the peudeucy of said petition, and the hearing thereof, by causing a copy of this order to be published in the Ann Arbor Courier, a newspaper printed and circulating in said county, three successiye weeks previous to said dav of hearing. Kinne, one of the executors of the last will and testament of said deceased, haviug resigned bis trust as such executor, comes iuto courf aud represents that he is now prepared to reuder bis accouut as executor of the last will and testament of said de'leased. Thereupon it is ordered, that Friday, the 8th day of February next, at ten o'clock; in the forenoon, be assigued for examining and allowing such account, and that the devisees, legatees and heirs-at-law of said deceased, and alïother persous interested in said eslate, ave required to appear at. a sessiou of said court then to be holden at the Probate Office, in the City oí Ann Arbor, in said couuty, and show cause, if any there be, why the said accoun should not be allowed. And it is further or dered that said executor give notice to the persons interested in said estáte, of the pen dancy of said account, and the hearing there of. by eausing a copy of this order to be pub lished in the Ann Arbor Courier, a newspape printed aud circulating in said count, three successive weeks to said day of hearing. It satisfaetorily appearing to tuis court by amdavit on bill, that the defendant, rence Lampkin, is not a resident of this state, but resides iu the state of Nebraska, on motion of A. G. Kingsbury, complainant's solicitor, it is ordered that the said defeudant, Lawreuce Lampkin, cause his appearance to Be entered herein, withiu flve (5) months from date of this order, and iu case of his appearauce that he cause his answer to complainant's bill of complaint to be flled, and a copy thereof to be served on said complainant's solicitor withiu twenty (20) days after service on him of a copy of said bill, and notiee of this order; and that in default thereof, said bill be taken as confessed by the said non-resident defendant.
