In view of the fact that it has buen a mooted question with the board of supervisors whether tlie 'county 'jail should be used for the city's prisoners, the following decisión by Judge Wisner, of Flint, will be of interest. He says very einphatically that the county must take the prisoners. Here is the Flint case : "The test case held in the circuit court to obt'ain a writ of mandamus compelling the sherift to receive prisoners convicted lor violation of the city ordinances and to safely keep them was decided against the action of the board of supervisors and Judge Wisner ordered the writ to issue. City Attorney Brennan in bis argument for the writ read section 2544 of Howell's annotated statutes and section 15 of the city charter, both of which provide for the use of the county jail by the city for purposes of coniinement, George F. Brown, attorney for Sheriff Garner, said in defense that the board of supervisors had, uuder the statute, the control of the county ings and that he eupposed that villages should have the same use of the connly that was allowed tl ie city, and he knew of no statute that would apply to tlüs particular case. Judge Wisnei' said he saw no reason'why tlie statutesof Michigan sliould not stand and therefore the writ must issue.
