Thereupon it is ordered, that Friday, Ih I7thday of April next at ten o'clock in tí; forenoon. be assigned for examining and h lowingsuch account, and that the devisee legateès and heirs-at-law of said decease and all other persons luterested in said estnt are reqnired to appear at. a sessíon of sai court then to be holden at the Probate Oflice ín the City of Ann Arbor, in said county, an show cause, lf any there be, why the said ac count snould not be allowed. State of Michigan, made and entered on the seventeeth day of June 1895, ín a certain cause thereln pending wherein John Christian Schmidi ís coinplainant and Sarah Fletcher and Mabel A. Fleteher are defendants. Notice is hereby jrlven that I shall sell at public auction to the hlghest bidder, at the east entrauce of the Court House, in the city of Ann Arbor, State of Michigan (that being ihe building in which the Circuit Court for the Couuty of Washtenaw is held), on Wednesday, the thirteenth day of May 1896, at ten o'clock in the forenoon of said day, the following described property situated in the city of Ann Arbor. County of Washtenaw and State of Michigan, to-wit:- Lot number seven in block nuraber three south of Hurou street in range number flve east, accordiug to the recorded plat of the village (now city) of Ann Arbor. At a session of the Probate Court for the County of Washtenaw, holden at the Probate Office in the city of Ann Arbor, on Monday, the twenty-third day of March. in the year oue thousand eight hundred and ninety-six. Present, J. Willard Babbitt, Judge of Probate. In the matter of the estáte oí William M. White, deceased. On reading and fillng the petltion, duly verifled, of Hngh White, et al by A. J. Sawyer, iLsq., their protector, praying that a certain instrument now ou file in "thls court, purporting to be a duly authenticated copy of the lastwill and testament of said deceased and the probate thereof in the state of New York may be allowed, filed and recorded in this court and that administration of said estáte maybe granted to Huuh White. Willtum Pierrepont White, and Herben L. White, the executors in said will named or to some other sultable person. Thereupon it is ordered, that Monday, the twentietn dayof April next, at 10 o'clock in the forenoon, be assigned for the hearing of said petition, and that the devisees, legatees, and heirs-at-law of said deceased. and all other persons interested in said estáte, are required to appear at a session of said court.then to be holden at the Probate Oflice in the city of Ann Arborán said County, and show cause, if any there be, why the prayer of the petitioner should not granted. And it is further ordered that said petitioner give notice to the persons interested in said estáte, of the pendency of said petition, and the hearing thereof, by "causing a copy of this order to be published in the Ann Arbor Courier, a newspaper printed and circulated in said County, three successive weeks previous to said day of hearing. DEFAULT havingbeen made, in the conditlons of a certain mortgage, made by by Michael Kenny, a single man of the City of Ann Arbor, Washtenuw County, and State of Michigan, lo Jeremlah Walsh of the same place, dated the 18tn day of April, A. D. 1885, and recorded in the office of the Register ol Deeds for the Couiity of Washtenaw, on the aOthday of April, A. D. 1885. in Liber 57 of Mortgages at page 616. Also another mortgage made by said Michael Kennv and Mary Kenny, hia wife, dated January 8tb, A. D. 1895 and recorded in the office ol the Hegister of Deeds for the County of Washtenaw, and state of Michigan, on the 25th day of June, A. D. 1895, in Liber 84 of Mortgages, on page 382, on both of said mortgages together there is claimed to be due at the date hereof two hundred and forty-one and twenty-seven one hundreds dollars, ($241.27). and an attorney's fee provided for in said mortgages and by the statute in caee of foreelosure proceedings, and no snit or proceedings at law naving been instituted to recover the moueys secured by said mortgages, or any part thereof: Now, therefore, by virtue of the power of sale contained in said mortgages and the statute in such cases made and provided. NOTICE is hereby given that on Monday, the 27th day of April, A. D. 1896, at 9 o'ciock in the forenoon, city time, I shall sell at public anctlon to the highest bidder, at the westerly front door, or eutrance to the Court House, in the City of Ann Arbor, that being the place where the Circuit Court for Washtenaw County is holden, the premlses described in said mortgages or so much thereof as may be necessary to pay the amount due on said mortgages, witli interest as provided in said mortgages, and all legal costo, together with the attorney's fee provided for by statute in case of the foreelosure ol said mortgages. The premlses described in said mortgages being the same in each mortgage, are situated in the City of Ann Arbor, County of Washtenaw, and State of Michigan, known and described as lot umbered six and seven, and the south half of trac 'nal lot number elght, in block numbered toui nnrth of Hurón street, in range numbered tu. -o east, accordlng to the recorded plat of tbe Village, now City of Ann Arbor, Coiu ty of Washtenaw aforesald. And it is further ordered that said guardián give notice to the persons interested iu said estáte, of tlie pendency of said account, and the hearing thereof, by causiug a copy of this order to be published in the Ann Arbor Courier, a nowspaper printed and circulated iu said county, three successive weeks previous to said day of hearing.
