Judge Xewkirk heard the preliminary testimoiiy in the Marietta Bennett will case Saturday. Three witnesses were examined, Messrs. Knapp, Rome and Sweeting, but nothing new was brought out, except that Svveeting claimed to have ritten the will for Miss Bennett. Mr. Butterfield, of Lawrence & Butterfleld, appeared for Schermerhorn and the will, and Capt. E. P. Allen and Prosecntiug Attorney John P. Kirk for the estáte. At one time when the attorneys mistook the court for a political convention, Judge Newkirk adjourned the court for an hour or so to allOW the disputants time to lalk it out. The case was finally adjonrned until 6ept. 15, to give those connected with it time to rest up froni the laborious labors of Saturday - and for other good reasons no doubt.
