On Saturday Judge Kinne heard au Injunction case. A. H. Holmes lm ving bought a lot ïying between houises owmed by Dr. J. N. Martin and t:toe residemce of Col. H. S. Dean oa E. Liberty st., the intention of erecting a livery baxn Uiereon, Dr. Maa-tin got out aai injunction 1o restrain hini fi-om car ry ing out hla iintentions. llon. A. J. Bawyer appeared for tlue complaüiants and M. J. Cavanaugh for Mr. Holmes. The mat Ion to make the injunction perpetual was denied. The case has causod considerable coonment on tlie ist reets. Judge Kinne's decisión, white denying the permanent injunction, is very ïimch Hke the verdict, of the jury: "We bring the prisoner in not guilty, hut he must not do it again." The document we publish in full, that our readers may understand it more fully: The argumenta in this matter, with the authorities presented, inclines me to the opinión that a case for relief by injuuction is made by the Bill oí Complaint in this cause. A counter showing by aflUlavit is made, and at present I am not prepaied to hold that a livery stable, condacted in the marmer iudicated in this showing on the part of the defendant is auch a grievauce that its operation can be stayed by injunction. Au issue is thus raised which can not be satisfactorily deterrained except by the production of proofs. It is therefore impossible for me at present to further indícate what decree, if any, should be made at the final hearing of the cause apon the evidence. I think the application for an injunction sliould be denied witheut prejudice and without costs. E. D. Kinne, Circuit Judge.
