Herman Hardinghau, of Ann Aibjr, by his solicitors, Chas. R. Whitman and J. F. Lswreace, has filed a bilí cf coraplaint asking ttat the couaty clerk be restrained from calling the local op'-ion election, and Judge Kiane hag set next Monday at 10 a. m. for hearing the Cisa. Mr. Hardinghaup, wuo is a well-known brewer of Aan Arbor, recites that he is possessed of property which, if a mijoricy of the electora of the county shouM vote against the manufacture and sale of iutox icating liquors, would be rendered worthles.B. It would resul', he says, in his absolute ruin. He decUres that the act granting local option 19 unc, nstitutional, for the following reascn : First, it violates that provisión of the constitution of the State which provides that no law sliall embrace more than one object which shall be express'idin its title; Second, said act is utjconititutional and void as beiog in conflict with section 38 of article 4 of the constitution of the state of Michigan in that it con'.ains a delegation of powers not provided for by said section 38. It violates that provisiou of the oontitution (hat no person shall be deprived of life, liberty, or property without due process of the law. He claims that because the petitions are on separate and detached papers, that it is not properly a petition bearing the names of at least one-Bfth of the electora. He also objacts because a large proportion of the names on the petiticn are given with initials instead of the given name.
