Tbe twenty-second Judicial Circuit in Chancery, Suit pending in the Circuit Court for the Couniy of Washtenaw in Chaucery, at Ann Arbor, on the second day of November, A. D. 1888. In this cause it appearing from affidavit on file that the said riefendant, J. G. Bailey, executor of the will of Julia A. Reynolds, deceased. i not a resident of this state, but is a resident ot Santa Ann, in Lus Angeles County, in the State of California. On motion of complainant's solicitor, it is ordi-red that the appearance 01 said non-residemdefendant. J. G. Bailey, execator as aforesaid, be entered herein withiu tour months f rum the date of Ihis order; and iu case of his appearance he cuuse his answer to the bill of compiaint to befiled and a copy thereof to be served on the complainant's solicitor vrithin twenty days after service on him of a copy of said bill and notice of this order; and in del'ault thereof said bill will bj taken as co fe-sed by said nou-resident defendant. And it is further ordered that within twenty days the complainant cause a notice of this order to be publlsned in the Anu Arbor Register, a newspaper printed, published aud circu.ating in said County and that said publication be continued the ein, once in each week, for six weeks In suocession, or that he cause a copy of this order to be personally served on said nonresident detendant at lea&t twenty days beiore the tini2 above prescribnd for his appearance. Cheever, execuiors of the will of Hiram Arnold, deceased, to secure the paymeut ol certain principal and interest therein mentioned, wMch niortKage bears date January25th, 188fi, and was reeorded in the office ot the Register of Deeds for VVashtenaw County, Michigau on the 2Mh day of January. 1886 at 9% o'cloek, p. m., in Liber 69 of Morlgges on page 74 and where as default has been,made for more than sixty days in the payment of an instailmcnt of interest which became due thereon on the 25th day of January, 1887 as welt as the succetding i i st allment of interest which became due thereon January 25th, 188, and by reason thereof and pursuautiothe termsof said mortgage, the principal sum unpald ol said mortgaue of twenty-one hundred and ten doilars with all the arrearage of interest thereon, at the option of said mortgagees became due and payable imtnediately therealter and the power of sale contained in said mortgage became op rative, and the said mortggees do herehy declare ittheir option an 1 do hereby elect to have the principal sum of said mortgage and all interest theieon become now due and iayable. Cheever to Le Roy C. Noble by deed of assignment. dated December 6. 18 7, and recorded In said Pegister's office, in Liber 9, of assigumente of mortgages, on page 393 by which default the power of sale contained in said Mort)age became operative, and no suit or proceeding in law or equity having been üistituted to recover the debt ecured by said Mortgage or any part thereof, and the sum of two hundred and thirty-three and 50-1U0 dolíais (Í233.50) bein now claimed to be due upon said Mortgage.
