This morning the executors of the estáte of Luther James filled a notice of appeal in the circuit court from the decisión of the commissioners, in the claim of the city of Ann Arbor against the estáte for taxes. The 8mount allowed by the commissioners was $2,138 65. Iaimediately after filing the sppeal, tlie attorneys for the estáte and the city met and settled the case, the estáte paying the sum of $1,888.00, and each side paying their own costs in the suit thus far. This will end all contest on the taxes of the James estáte until it ís settled. The estáte will be taxed in this city for $112,500 on personal property, the executors consenting to this amount. This ends one of the most important suits for taxes ia this state and is a signal victory for the city. The stipulation under which the appeal was settled is as f olio ws : State of Michigan; The Circuit Court f"r the County of Wfushtenaw : In th9 matter of the appeal of the executors of the estáte of Luther James, deceased, from the allowance of the claim of the mayor, recorder and aldermen of the city of Ann Arbor against said estáte as allowed by the commission on Claims : Whereas, the said mayor, recorder and aldermen of the city of Ann Aibor filed and prosecuted a claim before said commissioners for 82,lú8.78 and which claim after being heard by the commissioners was allowed at the sum of $2, 138.65, which was before said commissioners and is now objected to by said executors; And whereas, the executors of said estáte have appealed to the circuit court from said allowanee which said appeal is now pending in said circa t court; And whereas, all the 6aid parties to this cause to avoid expensive litigation have and do hereby aeree to dispose of said case without further litigation upon the following tenns and conditions, viz.: The mayor, recorder and aldermen of the said city hereby withdiaw the said claim in this cause and stand as though the same had never been presented to said commissioners, and in consideration thereof the said exe".utors of sa!ï estáte herewith pay over to the city the sum of aighteen hundred and eighc-eight dollars in fuil of said tax claim for personal taxes of Luther James' estáte; such payment to have the effect as if the same had been paid to the proper officcr under protest, the said executors hereby waiving all rights of action to recover back said sum of money.
