The defunct Imperial Life Insurance company of Detroit made application for a writ of mandamus compelling the state treasurer to pay over to the trustee Í34,OOO of the Í 100,000 deposited in his hands for security of policy holders for the purpose of litigation of death Losses aceumulating. The writ was denicd upon the pround that it is impossible at this time to know what are the liabilities, and in justice to policy-holders and other creditors the deposit of $100,000 should reinain intact untü a distribution is legally made to all the creditors.
