Starks. the guardián nf sáld ward, comes into court and represents thai he íh now prepared to rendir tiis 24th annual account as sucfc guardián. Thereupon it is ordered, that Tuesday, the 12tli day of June riext. at ten o'clock in the Torenoon, be assigned for examing and allowIngsuch account, and tliat thenext of kin of said ward and al! other persons Interested in gaid estáte are required toappearat a mssion of said Court, then to be holden at the Proüate Office, in the City of Ann Arbor, in said ('ountv, and show cause, if any there be, whythe said account' should no be allowed: And it is further ordered that said iruardian ive notice to the persons interested in Baid estáte, of the penuency of said account, and the hearing thereof, by causing a copy of tliis order to be published in the Ann Akhoh Register, a nerwspaper prlnted and clrculating in said county, three successive weeks nrevious to said day of hearing. David R. S. Underwood, C'omplainant, vs. Alvah P. Ferguson. N'ellie II Ferguson, The Western Linoleum Co , Charles T. Blanchard, Frank E. Hale and Wood, Siniih & Co., Defendants. Snit pending in the Circuit Court for the County ot Washtenaw, in Chancery at Ann Arbor, on the Tth day of April, a. d. 1894. In this cause, it appearing from affidavit on file, that the defendants, The Western Linoleum Company. Charles ï. Blanchard. Frank E. Hale, and Wood, Smith & Comp-ny are not residents of this state, but that the said Western linoleum Company resides at Akron in the State of Ühio, that said Charles T. Blanchard and Frank E. Hale reside at Syracuse In the State of New York and that said Wood. Smith & Company resides at Fort Plain in the State of New Yoik, on motion of Lawrence & Butterfield, complainant's solicitors, it is ordered that the said defendants, The Western Linoleum Company, Charles T. Klanchard, Frank fi. Hale and Wood, Smith & Company cause th ir appearance to be entered herein, wihin four months from the date of this order, and in case of their or either of their appearance that they respectively cause their answf r to the eomp'ainant's bill of complaint to be flled, and a copy tdereof to be served on said complainant's solicitors, within twenty days after service on them of a copy of snid bill, and notice of this order; and that in default thereof, süd bill be taken as confessed by each of the said non-resident defendants who have not complied with this order. And it ís further ordered that within twenty days the said complainant cause a notice of this order to be published in the Ann Arbor Register, a newspaper printed, published and circulating in said county, and that said publication be continued there at least once in each week, for six weeks in succession, or that eaid complainant cause a copy of this order to be personally served on said non-resident defendants at least twenty days before the time prescribid for their appearancp. De:ault having been made in the payment of the money secured by a mortgage dated the 25th day of April in the year 1891, made by Lizzie A. McClenahan to Hannah Drury, and which was recorded in the office of the Register of Deeds of the county of Washtenaw, State of Michigan, on the lst day of June, 1891, in Liber 77 of morgages, on page 248, wbich said mortgage was upon the22d day of June, 1893, duly assigned to Emily C. Place of Peoria, 111., which assignment was upon the 29th day of March 1894, duly recorded in the office of the Register of Deeds of said county in Lber 11 of assignments of mortgages on page 584. and whereas the amount c'aimed to be due on said moi tgage at the date 'of this notice. is the sttm of six hundred umi eighty-one and (57-100 dollars and fifteen do'lars as an attorney's fee, and no suit or proceedings at law having been instituted to recover the moneys secured by said mortgage, or any part thereof. Now.therefore, by virture of the power of sale containi d in said mortgage and the statute in such case made and provided, notice is hereby given that on Saturday, the 30th day of June, 1894, at ten o'clock in the forenoon, I shall sell at public auction or vendue, to the highest bidder, at the north front door of the court house in the city of Ann Arbor (that being the place where the circuit court for Washtenaw county is holden) the premises described in said mortgage, or so much thereof as may be necessary to pav the amount due on said mortgage with accrued interest and all legal costs together with the attorney's fee of fifteen dol'ars therein provided for; the premises described in said mortgage being all that certain piece or parcel of land in the city of Ypsilanti, county of Washtenaw, state of Michigan, nd described as coramencing at a point where the west line of Normal street crosses the north line of Chicago avenue; thence west eight rods along the north line of Chicago avenue, thente north one hundred and ten feer, thence east eight rods to the west line of Xormal street, thence south along the west line of Normal street one hundred and ten feet to the place of beginning.
