City Attorney Jerold Lax has filed with the U.S. Circuit Court of Appeals an intent to appeal the ruling of Federal District Court Judge John Feikens in the Robert Hunter case. Hunter was fired from his post of assistant Human Rights Department director in February. He then filed a suit in Judge Feikens' court, charging discrimination. Judge Feikens, after hearing three days of testimony, ordered Hunter returned to the payroll and that he be given a hearing. He also said Hunter should receive back wages. Lax is claiming Judge Feikens abused his discretion in the matter. He said it would probably be at least two months before the Court of Appeals in Cincinnati could hear the appeal. In the meantime, he said, the city will proceed to set up a hearing in the Hunter firing.
