A mistrial was' declared 1 terday in the case of Robertl Smith who is charged with in-l citing to riot during the 1969I February demonstrations atl Eastern Michigan University. Circuit Court Judge Ross W.j Campbell made the ruling of al mistrial after five days of hear-j ing testimony on his own mo-l tion despite objections f rom bothl the prosecuting attorney and de-j fense attorney. "The court has had reserva-j tions about the relevance of student demands in this case. I am concerned over the extraneous issues, some of which have been inflamatory, that have been allowed," said Judge Campbell. "To allow this trial to continue would result in a mistrial." Defense attorney Kenneth Cockrell voiced "serious and strenuous objections" to the ruling. He said that the evidence and testimony had been entered in front of the judge and both attorneys and that if they had been improper they should have been ruled so at the time. "As far as I am concerned this prosecution has been terminated," said Cockrell. He said that to bring Smith to court again for this offense would be doublé jeopardy.
